Terms of Service

Effective date: August 17, 2026

These Terms of Service (“Terms”) govern your use of the Moera mobile application, connected-device software, cloud services, sleep and room-environment insights, and related support services (collectively, the “Services”). These Terms are between you and Moera Inc. (“Moera,” “we,” “us,” or “our”).

1. Acceptance

By creating an account, connecting a Moera device, or using the Services, you agree to these Terms and acknowledge the Moera Privacy Policy. If you do not agree, do not use the Services.

2. Eligibility

You must be at least 18 years old and legally able to enter into a binding agreement to use the Services.

3. The Services

Depending on your device, region, and software version, the Services may allow you to set up and control Moera devices, configure sleep zones and temperature schedules, view estimated sleep and room-environment insights, manage invited adults and device permissions, receive notifications, and contact support.

Features may change or differ by hardware model, firmware, operating system, and region.

4. Accounts and security

You must provide accurate information, keep it current, protect your password and devices, and notify us promptly of suspected unauthorized access. You are responsible for activity under your account to the extent permitted by law.

You may use Apple, Google, or X to sign in. Your relationship with that provider is also governed by its terms.

5. Connected devices and networks

You are responsible for compatible hardware, a supported phone, reliable power and network access, and following Moera setup, maintenance, cleaning, firmware, and safety instructions.

Do not use damaged, modified, improperly installed, wet, overheating, leaking, or otherwise unsafe hardware. Stop use and contact support if a product behaves unpredictably or appears unsafe.

Service availability may be affected by internet or power outages, maintenance, firmware installation, third-party services, and conditions outside Moera’s reasonable control.

6. Wellness information; not medical care

Moera provides general wellness, comfort, and sleep-environment information. Moera is not a healthcare provider or emergency service, and the Services are not intended to diagnose, treat, cure, prevent, or monitor a disease or medical condition.

Sleep stages, trends, temperature responses, and other insights are estimates and may be incomplete or inaccurate. Do not rely on the Services as a substitute for professional medical advice. Contact local emergency services in an emergency.

7. Sound-monitoring features

If you enable sound monitoring, raw audio and playable sound recordings remain on your Moera device or phone and are not uploaded to Moera servers. You are responsible for using sound features lawfully and respecting the privacy of other people in the room.

Do not use the Services to record another person where consent is required by law.

8. Shared devices

You may invite another adult to access a Moera device or sleep zone. Only invite a person if you are authorized to provide their contact information and share the relevant device or sleep information.

Do not access another person’s account, sleep information, sound recordings, or device controls without authorization. An account owner or authorized user may revoke access through the available controls.

9. Permissions and privacy

Some features require Bluetooth, local-network, notification, photo, location-related, or microphone permission. You can change permissions in system settings, but disabling a required permission may prevent the corresponding feature from working.

Moera’s handling of personal data is described in the Moera Privacy Policy.

10. Acceptable use

You must not:

We may restrict or terminate access where reasonably necessary to address misuse, security risks, legal requirements, or material violations of these Terms.

11. Software license and intellectual property

Moera grants you a limited, personal, non-exclusive, non-transferable, revocable license to use the software included in the Services for its intended purpose, subject to these Terms.

Moera and its licensors retain all rights in the Services, software, firmware, designs, trademarks, and content, except for content that you own. Feedback you voluntarily provide may be used to improve the Services without compensation or obligation to you.

12. Third-party services

The Services may work with third-party sign-in, app-store, network, or other services. Those services are controlled by their providers and may be subject to separate terms and privacy policies. Moera is not responsible for a third-party service except to the extent required by law.

13. Changes and availability

We may update the Services to improve performance, security, compatibility, and features, and may suspend a feature temporarily for maintenance, security, legal, or technical reasons.

If we discontinue a material service, we will provide reasonable notice where practical and comply with applicable consumer law.

14. Account deletion and termination

You may initiate deletion through Settings → Account → Delete Account and may stop using the Services at any time.

Moera may suspend or terminate access for a material breach, unlawful use, serious security risk, or where required by law. Where appropriate, we will provide notice and a reasonable opportunity to address the issue.

Sections that by their nature should continue after termination will survive.

15. Disclaimers

To the extent permitted by law, the Services are provided on an “as available” basis. Results may vary based on the user, environment, installation, connectivity, device placement, settings, and other factors.

Moera does not guarantee uninterrupted operation, perfect accuracy, a particular sleep outcome, or that every fault will be corrected. Nothing in these Terms excludes warranties or remedies that cannot lawfully be excluded.

16. Limitation of liability

To the maximum extent permitted by law, Moera is not liable for indirect, incidental, special, exemplary, or consequential loss arising from the Services, including loss caused by outages, inaccurate wellness estimates, unauthorized use, or failure to follow instructions.

Moera does not exclude or limit liability where doing so would be unlawful, including liability for fraud, willful misconduct, or death or personal injury caused by negligence where applicable law prohibits exclusion.

17. Consumer rights and disputes

These Terms do not reduce mandatory consumer rights available in your country or region.

If a dispute arises, please contact [email protected] first so we can attempt to resolve it informally. If it cannot be resolved, either party may use a court or dispute-resolution body that has jurisdiction under applicable law. European and UK consumers may use any forum and remedies available under mandatory local consumer law.

18. Changes to these Terms

We may update these Terms when the Services or applicable law changes. We will update the effective date and provide notice when required. If a material change requires consent, we will request it before the change applies.

19. General

If a provision is unenforceable, the remaining provisions remain effective. A failure to enforce a provision is not a waiver. These Terms and the Privacy Policy form the agreement governing the Services, together with any product-specific terms presented to you.

Hardware purchases, delivery, returns, and warranties may be governed by separate purchase and warranty terms.
